Coaching Agreement - CV Secrets Ltd
- Definitions
Your Name: (“You”)
Coach Name: Pamella Pritchard (the “Coach”)
Company Name: CV Secrets Ltd (the “Company”)
The Program: The Mastermind (the “Program”)
Fees: £1750
Session(s): 4 months access to the Mastermind + Access to bonus Q&A
Schedule: The Session dates will be agreed following purchase and the final session must be completed 6months from the first session.
- Brief and Fee Structure
2.1. Each session will be up to 60 minutes, additional time is discretionary.
2.2. The Sessions will be conducted over zoom unless otherwise agreed.
- The Company’s Commitment:
3.1 The Company will provide the coaching Sessions through the Coach.
3.2 The Company will provide coaching that is a professional client relationship designed to facilitate the creation and development of personal, professional, career or business goals and to develop and carry out a plan for moving towards those goals.
3.3 Voxer support and e-mails are welcome in between sessions to share successes, have urgent questions or challenges and responses will be provided between 12pm - 2pm AEST (or whichever timezone the Coach is based) Monday to Thursday.
- Your Commitment:
4.1 You agree to pay the Company the Fees as set out in this Agreement 7 days prior to the first session.
4.2 You agree to zoom, call or meet the Coach at the specified times.
4.3 You agree to be honest and open, to believe in yourself and to adopt a more enthusiastic and positive outlook on life from this moment onwards. You are truly committed to change and agree to take responsibility for your life, choices and actions.
- Coaching:
5.1 You enter into this Agreement with the full understanding that You are solely responsible for creating your own results. You understand that achieving your goals (in whole or part) cannot be guaranteed and no warranties are given.
5.2 You are aware that coaching is not counselling, psychotherapy, psychoanalysis or any other form of mental health care treatment or therapy, nor is it to be used as a substitute for professional advice by legal, medical, financial, business or other qualified professionals.
5.3 If appropriate, You will seek independent professional guidance in the areas indicated in 5.2 and You understand that all decisions and actions in these areas are Your sole responsibility.
- Your Agenda:
6.1 The Session agenda belongs to the Coach.
- Ethics and Confidentiality:
7.1 The Company follows the coaching ethics supplied in the Program.
7.2 Any notes the Coach makes during the Session or about You are kept confidential.
7.3 The Coach will not use or disclose the information You share with them during Your Sessions except as authorized by You or as required by law.
7.4 You understand that on occasion the Company may anonymously share screenshots or generalized information for marketing, training or consultation purposes. Your identity and any information that could lead to Your identification will remain entirely confidential.
- Admin:
8.1 The Session may be refused if payment has not been made as required by this Agreement.
8.2 Where it is necessary for either You or the Coach to reschedule a Session this will be done by email at least 48 hours before the scheduled Session and rescheduled prior to the next session starting or will be missed.
8.3 You will be charged for missed Sessions that are not rescheduled in accordance with this agreement, except in exceptional circumstances (at the Coach’s discretion).
8.4 If You are late for a Session, the Session will complete at the scheduled time.
8.5 Sessions are up to 60 minutes and additional time is discretionary.
8.6 Recordings of Sessions are available for 1 year from the start of the Program and will be uploaded at least 2 weeks from the date of recording, and sooner where possible, but not guaranteed. It is not guaranteed that all sessions can be recorded.
- Termination:
9.1 You or the Company may cancel this Agreement in writing (by email). In the event that you owe money to the Company at the time of cancellation, full payment will become due at the time of cancellation.
9.2 This agreement is non-refundable.
9.3 Upon termination of this Agreement the Company shall immediately cease to be liable to You in respect of the coaching Sessions.
9.4 Termination of this agreement will include termination of the access to the Program and Session recordings.
- General:
10.1 In the event of You choosing to feel mental, physical or emotional distress (or related ailment or condition) which You believe to be related either directly or indirectly to the coaching Sessions You will not hold the Company liable for any loss or cost incurred by you (or any person related to you). You will indemnify the Company in the event of any such claim.
10.2 Except as expressly set out in this Agreement the Company will have no liability to You. This Agreement reflects the entire agreement and understanding between You and the Company regarding the matters in this Agreement.
- Intellectual Property
11.1 The Company retains all ownership rights to the materials provided during your participation in the Program. The copyrighted and original materials you are provided are for your individual use only and with a single-user license.
11.2 You are not authorised to share, copy, distribute, or otherwise disseminate any materials received from me electronically or otherwise without my prior written consent.
11.3 All intellectual property, including the copyrighted Program materials, shall remain the sole property of The Company and no license to sell or distribute my materials is granted or implied. You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial or personal purposes, any portion of the Program, including any of the Program materials.
- Disclaimer
12.1 Although The Company makes every effort to accurately represent The Program, The Company makes no assurance, representation or promise regarding future earnings, client acquisition, income or career change or that Client will make any specific amount of money, or any money at all, or that Client will not lose money.
12.2 The Company does not guarantee that any employer or client will ask for Your information, or will interview or hire You.
12.3 The Company does not promise or guarantee that You will secure a new job, career change or generate revenue or clients.
12.4 There is no assurance that any prior success or past results regarding business building, job change, career change, earnings or income may be an indication of Your future success or results.
12.5 Statements or examples of actual earnings or business growth, or building or career change that are attributed to a specified individual or business are true and correct, and we will verify them upon request and also provide statements of expected typical results; however, these statements or examples should not be viewed as promises or guarantees of earnings or income. Earnings and income potential are affected by a number of factors over which The Company has no control, including but not limited to Your financial condition, talent, skills, level of effort, motivation, past experience and education, Your competition, and changes within the market.
12.6 For the foregoing reasons, You agree that The Company is not responsible for any decision You may make regarding any information presented to You via our website or via the Program.
12.7 You understand that because of the nature of The Program and extent, the results experienced by each client may significantly vary.
12.8 You accept and agree that You are 100% responsible for Your progress and results from The Program. Company makes no representations, warranties or guarantees verbally or in writing.
12.9 The Company and Coach is not an employee, agent, lawyer, doctor, manager, therapist, public relations, social media manager, VA, PA, business manager, financial analyst, financial advisor, marketing manager, social media manager, VA, PA, psychotherapist, therapist, doctor or accountant to You.
Additional Notes - For the coaching to be as successful as possible:
- Your intent to change and desire for change will be serious.
- You will make every effort to ensure You are at your peak mental, physical and emotional state for each Session. You are ready to work and receive feedback. You are willing to try new ways of learning, be honest and open, keep to your commitments and inform your coach immediately when things are not working for you.
- You are willing to explore, challenge and change thoughts, feelings and actions that you recognise as self-defeating.
- You understand your coach will be focused on you and your best interests as a whole, not just your goals.
- You are willing to give the coach the benefit of the doubt and wholeheartedly try new concepts or different ways of doing/approaching things.
- You recognise the value and worth of yourself and the investment you are making in your personal development.
- You understand the need to plan the relationship ending in advance to allow for a degree of closure and wrap-up.
